Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the JAST Store website and any related services, features, and content (collectively, the “Site”). In these Terms, “we,” “us,” and “our” refer to JAST, and “you” and “your” refer to any person who accesses or uses the Site.
By accessing or using the Site, you agree to these Terms and to comply with all applicable laws and regulations. If you do not agree, do not access or use the Site.
1. Incorporated Policies
The following policies are incorporated into these Terms by reference and form part of your agreement with us:
- Acceptable Use Policy (“AUP”)
- Adult Content Policy
If any incorporated policy conflicts with these Terms, these Terms control unless the policy expressly states otherwise.
2. Changes to These Terms
We may modify these Terms from time to time. The updated Terms become effective when posted on the Site (or as otherwise stated). Your continued access to or use of the Site after changes are posted constitutes acceptance of the updated Terms.
3. Eligibility and Legal Compliance
You represent that you are legally capable of entering into a binding agreement in your jurisdiction.
You are responsible for ensuring that your access to and use of the Site, and any purchase, download, or use of products, is lawful where you live. We do not represent that the Site or any product is appropriate or available for use in all jurisdictions.
4. Accounts and Security
4.1 Account Registration
Some features (including purchasing and library access) may require an account. You agree to provide accurate, current, and complete information and to keep it updated.
4.2 Credential Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account.
4.3 No Transfers
You may not share, sell, transfer, assign, or sublicense your account, your access to your library, or any license granted through the Site.
5. Digital Storefront; License to Digital Products
5.1 Storefront
The Site functions as a digital storefront.
5.2 License Grant
When you purchase a digital product, you receive a personal, non-exclusive, non-transferable, revocable license to access and use that product solely for your personal, non-commercial use, subject to these Terms and any product-specific terms presented at purchase or within the product listing.
5.3 Restrictions
Except where prohibited by law, you may not, and you agree not to:
- resell, distribute, publicly perform, publicly display, transmit, or otherwise make products available to others;
- modify, translate, adapt, or create derivative works from product files except as expressly permitted;
- decompile, disassemble, reverse engineer, or attempt to extract source assets or underlying code;
- bypass, disable, or circumvent technical protections, regional controls, age gates, or access restrictions.
6. Orders, Pricing, and Payment
6.1 Pricing and Availability
Prices, promotions, product availability, and supported payment methods may change at any time. Pricing may vary by region and may be adjusted based on location signals and/or your billing address. Applicable taxes (if any) are calculated at checkout.
6.2 Payment Processing
Payments may be processed by third-party payment providers. Your payment may be subject to the provider’s terms and policies.
6.3 Order Controls
We may refuse, cancel, limit, or reverse an order where we reasonably suspect fraud, abuse, policy violations, or where required for compliance or legal reasons.
7. Delivery, Access, and Availability
7.1 Delivery
Digital products are generally made available in your account library after successful payment processing.
7.2 Service Changes
We do not guarantee uninterrupted access to the Site or any particular feature, product, or integration. We may modify, suspend, discontinue, or restrict the availability of the Site (in whole or in part) or any product or feature at any time.
8. Refunds
8.1 Standard Refund Period
All purchases include a 24-hour, no-questions-asked refund period.
8.2 Extended Technical Refund Period
A limited extended 30-day refund period is available only for technical issues that prevent the software from running as intended.
8.3 How to Request
To request a refund, you must contact support within the applicable refund period.
8.4 Abuse and Chargebacks
We may deny refunds and/or restrict accounts for refund abuse, chargeback abuse, fraud, or violations of these Terms or the AUP. Chargebacks may result in account restrictions and/or loss of access to associated digital products, to the extent permitted by law.
9. Intellectual Property
The Site, including its software, design, text, layout, and branding, is owned by or licensed to JAST and is protected by intellectual property laws. All trademarks, product titles, and character rights belong to their respective owners. Except for the limited license granted to you under these Terms, no rights are granted to you by implication or otherwise.
10. Third-Party Services and Links
The Site may include links to, or integrations with, third-party services (including payment processors, embedded media, or external support portals). We do not control and are not responsible for third-party services, content, availability, security, or practices. Your use of third-party services may be governed by separate terms and policies.
11. Disclaimers
THE SITE AND ALL MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JAST AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SITE OR ANY PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR TOTAL LIABILITY FOR ANY CLAIM EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions do not allow certain limitations; in such jurisdictions, these limitations apply to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless JAST from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; or (c) your violation of any rights of any other person or entity.
14. Suspension and Termination
We may suspend or terminate your access to the Site and/or your account at any time if we reasonably determine you have violated these Terms or the AUP, if we reasonably suspect fraud or abuse, to comply with legal or payment processor requirements, or as otherwise required by law. We may also restrict access to products associated with an account subject to enforcement actions, to the extent permitted by law.
15. Enforcement; Reports of Non-Compliant Content
We are committed to maintaining a storefront that complies with our content policies, and we may review, restrict, or remove access to content, products, or listings to enforce our Terms of Service, Acceptable Use Policy, Adult Content Policy, and applicable law.
Not all content available on the JAST Store is owned or produced by JAST USA. Some products are published or licensed through third-party partners. While we carefully curate the content available on our platform, if a partner is found to have published content that violates our policies or applicable law, we will address the matter accordingly — up to and including removal of the content and termination of the partnership.
If you believe any content on the Site violates our policies or applicable law, you may submit a report to our support team with a description of the content in question and the specific concern or policy you believe has been violated. We aim to review and address all reports within five (5) business days of receipt. If we have credible evidence that content is illegal or non-compliant, we will remove it or restrict access promptly, and where appropriate immediately. Submitting a report does not guarantee removal of content; each report is evaluated on its merits against our policies and applicable law.
16. Governing Law
These Terms and any claim relating to the Site or these Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Acceptable Use Policy
This Acceptable Use Policy (“AUP”) applies to your use of the Site and is incorporated into the Terms of Service. Violations may result in content restrictions, order cancellation, account suspension or termination, and/or cooperation with lawful requests from authorities.
1. Prohibited Conduct
You may not misuse the Site, products, or any related services. Prohibited conduct includes, without limitation:
1.1 Illegal Activity
Using the Site in violation of law or to facilitate unlawful conduct.
1.2 Fraud and Payment Abuse
Fraud; use of stolen or unauthorized payment instruments; chargeback abuse; refund abuse; false disputes; attempts to manipulate pricing, taxes, or regional restrictions through deception.
1.3 Security and Interference
Attempting to gain unauthorized access to the Site, accounts, networks, or systems; probing or scanning for vulnerabilities; interfering with service operation; introducing malware; denial-of-service activity.
1.4 Automation and Scraping
Automated access (bots, scrapers, crawlers) that materially impacts performance, bypasses controls, harvests data at scale, or attempts to enumerate accounts, orders, or libraries.
1.5 Rights Violations
Infringing intellectual property rights; misappropriating content; distributing unauthorized copies.
1.6 Harassment and Abuse
Harassing, threatening, or abusive conduct toward staff, contractors, or other users (where applicable).
1.7 Circumvention
Circumventing age gates, adult content display controls, regional restrictions, or technical protections.
2. Anti-Trafficking and Exploitation
You may not use the Site, your account, or any Site features to facilitate, promote, or profit from real-world trafficking, exploitation, or illegal services. Prohibited conduct includes, without limitation:
- Using the Site or related communications to coordinate, advertise, or arrange trafficking or exploitation.
- Attempting to recruit, solicit, or exploit any person in connection with illegal sexual services.
- Any real-world activity involving a minor that is exploitative, harmful, or involves solicitation.
3. Enforcement
We may remove access, suspend or terminate accounts, cancel orders, and restrict use of the Site for violations of this AUP or the Terms of Service. When required or appropriate, we will cooperate with lawful requests from authorities.
Adult Content Policy
This Adult Content Policy applies to adult-oriented portions of the Site and is incorporated into the Terms of Service.
1. Scope and Purpose
The Site is a curated storefront offering professionally produced, fictional illustrated works only, including drawings, comics, and animated or computer-generated imagery (CGI); it is not a user-upload platform and does not accept or host user-generated content. No content on the Site depicts real people: the Site does not sell, display, or distribute photographs, videos, live-action footage, or any other visual depictions of actual human beings, and it does not use or feature human models.
2. Legal Adult Access Only; Regional Restrictions
Adult-oriented areas of the Site are intended only for individuals who (a) are legal adults and (b) are legally permitted to access adult content where they are located. You may not access or view adult areas or adult products if doing so would violate any applicable law, regulation, or restriction in your jurisdiction.
We may restrict or block adult content in certain regions to comply with law, payment processor requirements, or risk controls. You agree not to circumvent any regional controls, age gates, or access restrictions.
3. Display Controls and Access Restrictions
We may offer controls intended to reduce or hide the display of adult imagery (for example, “safe display” options). These controls are provided for convenience (including viewing in public settings) and do not change the underlying nature of adult products.

4. Complaints Policy

5. Exemption Notice for 18 U.S.C. § 2257
All visual depictions displayed on this website, including but not limited to illustrations, cartoons, drawings, animations, and computer-generated imagery (collectively, "Content"), are entirely fictional works created by human artists or generated through digital and computational means. No Content displayed on this website depicts, portrays, or represents actual human beings in any capacity.
This website does not display, host, distribute, or otherwise make available any visual depictions of actual human beings engaged in actual or simulated sexually explicit conduct as defined under 18 U.S.C. § 2256. All characters depicted in any Content on this website are fictional constructs with no real-world counterpart. Any resemblance to actual persons, living or deceased, is entirely coincidental and unintentional.
Because this website exclusively displays fictional, non-photographic visual depictions, it qualifies for the exemption set forth in 18 U.S.C. §§ 2257 and 2257A and is not subject to the record-keeping, disclosure, or labeling requirements mandated by 28 C.F.R. Part 75. No records pertaining to actual performers are required to be maintained, as no actual performers are depicted in any Content on this website.
